REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy (“Policy”) governs the terms under which refunds, cancellations, or adjustments may be requested for services purchased through ItsMyBrand.in, operated by Brands & Brains LLP (“we,” “us,” “our”).

By availing any service on this Website, the User (“you”) acknowledges and agrees to the terms set forth below.

1. Nature of Services

The services offered by ItsMyBrand.in primarily include:

  • Trademark filing support
  • Trademark search and analysis
  • Documentation and compliance assistance
  • Monitoring and tracking services
  • Expert consultation and advisory support
  • Brand valuations
  • Brand Management
  • Brand Transfers

The services offered through ItsMyBrand.in are specialized professional services that require dedicated time, expert involvement, and tailored attention to each user’s specific requirements. As a result, certain preparatory and procedural activities begin promptly once an order is confirmed, meaning substantial effort is often initiated at the outset of the engagement.

2. Refund Principles

Refunds are governed by the following general principles:

A. Refunds are limited because services are knowledge-based and effort-driven.

Upon commencement of service delivery — including, without limitation, the initiation of trademark searches, document preparation, verification of details, expert review, or commencement of filing-related procedures — the service shall be deemed to have been duly initiated. Once such processes have begun, the fee paid shall become non-refundable, and no refund shall be issued under any circumstances.

B. Government fees are strictly non-refundable.

Any statutory fee, government fee, or official charge paid in connection with trademark filing or any related regulatory process is strictly non-refundable. Such fees are remitted directly to the competent governmental authorities and, irrespective of the status, progress, or outcome of the application—including objections, examination requirements, oppositions, delays, refusals, or rejection—shall not be returned or reimbursed under any circumstances

C. Refunds are issued only in exceptional and defined situations.

3. Scenarios Eligible for Refund

A refund may be issued only under the following circumstances:

(a) Duplicate Payment

In the event that a User is inadvertently charged more than once for the same order or transaction, the duplicate or excess amount shall be eligible for refund upon verification. Such verification shall include confirmation of the duplicate charge through our internal records, payment gateway reports, and bank transaction details. Once the duplicate payment is authenticated, the excess amount will be refunded to the original mode of payment within the standard processing timelines. This provision applies solely to bona fide duplicate transactions and does not extend to separate or unrelated orders placed by the User

(b) Payment Failure

If your payment is deducted but the order is not generated, the deducted amount will be refunded by the payment gateway/bank as per their settlement timelines.

(c) Service Not Initiated by ItsMyBrand.in

If, due to internal reasons, we are unable to initiate the service within the committed timeframe, and no work has been performed, you may request a refund.

(d) Service Unavailability

If the specific service ordered is discontinued or temporarily unavailable before initiation, a refund may be processed.

4. Scenarios Not Eligible for Refund

Refunds will not be issued in the following circumstances:

(a) Work Already Initiated

Once our team has:

  • Conducted preliminary trademark search and communicated the same to the Applicant
  • Initiated drafting of the application
  • Gathered/verified documents
  • Communicated with you regarding your filing

The service is deemed initiated and non-refundable.

(b) Trademark Filing Completed

Once your application has been successfully filed with the Registrar of Trademarks, the service is completed, and no refunds are permissible once the application number is generated by the authorities concerned.

(c) Government Fees Paid

Statutory government fees are non-refundable under any circumstances.

(d) Delay or Rejection by Government Authorities

Refunds will not be issued for:

  • Delays in processing by the Trademark Registry or other authorities concerned.
  • Objections received against the application by the Registrars concerned
  • If Examination reports are issued
  • Rejections or refusals
  • Oppositions filed by third parties

These factors are beyond our control and purely legal processes.

(e) Change of Mind

Refunds will not be issued for changes in personal preference, changes of business plan, or decisions unrelated to service performance.

(f) Incorrect or incomplete information provided by the User

If delays or outcomes occur due to user-provided errors, no refund will be granted.

5. Service Cancellation Policy

Cancellation is permitted strictly under the following conditions:

  • Cancellation request must be submitted before the work begins.
  • Once work has started, cancellation is not possible.
  • Government fees once paid can never be cancelled or refunded.

6. Refund Processing Timelines

If a refund is approved:

  • Refunds will be processed within 7–14 business days.
  • The amount will be credited to the original payment method used.
  • The timeline may vary depending on the bank or payment gateway.

We are not responsible for delays caused by banking or payment gateway processes.

7. Non-Transferability

Approved refunds cannot be:

  • Transferred to another person
  • Adjusted against other services
  • Converted into credits unless explicitly offered as a goodwill gesture
8. No Guarantee Clause

Refund approval is strictly based on the conditions listed in this Policy.
Submission of a refund request does not guarantee approval.
