1. Use of the Website

• Submitting trademark filing information
• Purchasing services offered
• Obtaining legal or procedural information for personal/business use

You agree not to misuse or attempt to disrupt Website operations.

2. Eligibility

To use our services, you must:

• Be at least 18 years old
• Have the legal authority to enter into binding agreements
• Provide accurate and complete information

3. Service Nature & Scope

ItsMyBrand provides:

• Trademark filing support
• Trademark search and analysis
• Trademark monitoring and real-time tracking
• Brand protection documentation
• Legal assistance through expert partners
• Educational resources
• All services related to Brands, like valuation, exchange, assignment, transfer, purchase, and sale of the brands

The grant of any trademark is solely at the discretion of the Registrar of Trademarks, Government of India. ItsMyBrand.in acts only as a facilitation and support platform to assist applicants in preparing, filing, and monitoring trademark applications submitted before the competent authority. The process of obtaining a trademark registration is governed strictly by the provisions of the Trade Marks Act, 1999, and the Rules made thereunder, and every applicant is required to undergo the statutory examination, publication, opposition, and approval procedures prescribed under the law. No deviation, circumvention, or bypassing of the legally mandated process shall be permitted or undertaken by ItsMyBrand.in under any circumstances.

4. Account Registration

You may be required to create an account. You agree to:

• Maintain confidentiality of your login details
• Notify us immediately of unauthorized access
• Assume responsibility for all actions under your account

5. Accuracy of Information

You agree to submit correct, accurate, and updated information.

We are not responsible for errors, delays, or refusals arising from incorrect data provided by users.

6. Payments

All payments for services availed through ItsMyBrand.in shall be made exclusively through the authorised and secure third-party payment gateways integrated on the Website. Service fees are subject to revision or modification at any time without prior notice, and the applicable fee shall be the one prevailing at the time of the transaction.

Government fees, statutory charges, or any official costs payable in connection with trademark filing or other regulatory processes are separate and independent of the service fees charged by ItsMyBrand.in. Such government fees are remitted directly to the concerned authorities on behalf of the applicant and are strictly non-refundable under all circumstances, irrespective of the outcome of the application, processing delays, objections, refusals, or rejection by the competent authority.

7. Intellectual Property

All content on the Website, including text, logos, design, and graphics, is owned by ItsMyBrand.

Unauthorized copying, reproduction, or distribution is prohibited.

8. Third-Party Services

We may use third-party partners such as:

• Payment processors
• Logistics providers
• Analytics services
• Legal & Professional associates

We are not responsible for failures or breaches by third parties.

9. Limitation of Liability

We are not liable for:

• Trademark rejection by authorities
• Delays caused by government portals
• Technical errors or downtime
• Loss of data or revenue
• Decisions made by third-party registries
• Loss caused by an act of God
• Pandemics and health emergencies
• War conditions if any 

Our liability is limited to the service fee paid for the concerned service.

10. Termination of Services

We reserve the right to:

• Suspend or terminate accounts
• Cancel orders
• Block access
• Withhold services

If any misuse, fraudulent activity, or violation of Terms is identified.

Fraud: For these Terms, ‘fraud’ shall mean any act, omission, misrepresentation, or conduct carried out with the intent to deceive, mislead, or unlawfully benefit, whether directly or indirectly. Fraud includes, but is not limited to:

1. Providing false, inaccurate, forged, or misleading information or documents during registration, filing, or use of services.
2. Using another person’s identity, contact details, payment information without their free consent, or trademark ownership details without lawful authority or consent.
3. Submitting unauthorized or fictitious applications or attempting to obtain services under false pretenses.
4. Attempting to manipulate, hack, disrupt, or gain unauthorised access to the Website, systems, or databases.
5. Initiating chargebacks or payment disputes for legitimately delivered services.
6. Engaging in any act intended to abuse, exploit, or circumvent the processes, fees, or legal requirements prescribed under the Trade Marks Act, 1999, and related rules and other applicable laws.

Any activity that constitutes an attempt to gain unlawful benefit or cause wrongful loss to ItsMyBrand.in, its partners, or any third party shall be treated as fraud.”

11. Governing Law

These Terms are governed by the laws of India for domestic applications and international laws for International applications.

Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad only.
